DMB songs used for abc college football games

I've noticed that all throughout this college football season that during the games on ABC when they go to commercials they have been playing alot of dave tunes. Mostly playing the Tripping Billies intro and some stand up stuff. Its always nice to hear some dave, but i was wondering does ABC have to get the bands consent to play the songs even though its only played for a couple of seconds?
